Section 445 - COMMISSARIES

445.01 License Required. No person shall operate a grocery, that supplies residents of an apartment, an apartment complex, a hotel, or resident club, without first having secured a license therefore as hereinafter provided.

445.05 Application for a License. Any person desiring to operate a commissary as set forth in Section 445 shall make a written application for a license to the City Clerk, which application shall set forth the name of the applicant, the specific place wherein he or she proposes to operate such commissary, the apartment, apartment complex, hotel, or resident club to be served thereby, the number of residence units therein, the name or manes of the owners of said apartment, apartment complex, hotel, or club together with division of ownership, if any, categories of merchandise proposed for sale, square foot area of the designated retail sales area, the location of such retail sales area with respect to side lot lines of the said apartment, apartment complex, hotel, or resident club land, the relation of such retail sales area with respect to public thoroughfares, and the distance of such commissary from the nearest general grocery store and nearest general drug store.

445.10 Issuance, Expiration, Fees. Upon receipt of such application, the City Clerk shall forward the same to the City Council which shall consider the same, and if satisfied that such applicant is proper, that such license is issued whether conditional or unconditional will protect the spirit and intent of the zoning ordinance, shall order the issuance of the same. The Council may, in it discretion, impose such conditions as may in its discretion appear proper and necessary to protect the spirit and the intent of the zoning ordinances and the general welfare of the public, and may direct the endorsement of such conditions upon the license as conditions to said license. If the Council directs issuance of such license the Clerk shall, upon payment of the license fee as established in accordance with the provisions of section 500 of the City Code, endorse such conditions as may have been imposed by the Council upon the license and thereupon issue the license to the applicant. Said license shall expire on June 30 of each year. (ORD. 01-2001, 2/25/01)

445.15 Prohibited Acts. No such commissary shall advertise its merchandise or prices in media designed for a readership or audience including persons other than residents of such apartment, apartment complex, hotel, or resident club. Such commissary shall not advertise its existence except to tenants and prospective tenants of the apartment, apartment complex, hotel, or resident club. No such commissary shall identify its existence or location by sign or symbol visible and recognizable from any public thoroughfare, public grounds, or public parks.
